These Terms and Conditions ("Terms") govern your use of www.diamondbackfunding.com and the services Diamondback Funding Inc. ("Diamondback", "we", "us") offers through it. By using the site or submitting an application, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the site.
Who May Use the Site
You must be at least 18 years old and located in the United States. Funding is not available in all states, and the site is not an offer to residents of states where we do not fund.
What We Do
Diamondback arranges non-recourse pre-settlement and post-settlement funding for plaintiffs with pending or settled legal claims. Funding is not a loan; repayment comes only from the proceeds of your claim, and if your case is lost you owe nothing, subject to the fraud exception below. All funding is subject to case evaluation and approval. Funding is provided by Diamondback Funding or one of its funding partners. Your agreement identifies the funding company and states your exact repayment terms before you sign. Funding requires an attorney representing you on a full contingency fee basis who signs an acknowledgment of the funding agreement. We cannot fund without both. Your funding agreement, not these Terms, governs any advance.
Your Application
You agree that the information you give us is true and complete and that you will tell us if it changes. Submitting an application creates no obligation on either side: you may decline any offer, and we may decline any application.
Fraud and Material Misrepresentation
Non-recourse protection does not apply where a funding recipient commits fraud or materially misrepresents facts in connection with the application or the underlying claim. In that case the amount advanced and the disclosed charges remain due. This exception is standard in funding agreements.
Calls, Texts and Email
By submitting an application you agree that Diamondback may call or text you at the number you provide about your application, including with automated dialing or prerecorded messages. Consent is not a condition of funding. Message and data rates may apply and message frequency varies. Reply STOP to stop texts or HELP for help; carriers are not liable for delayed or undelivered messages. You can withdraw consent to calls at any time by telling us.
Electronic Communications
You agree that we may send notices, disclosures and other communications about the site and your application electronically, by email or text, and that electronic communications satisfy any legal requirement that they be in writing. You may ask for a paper copy of any notice at no charge. Your funding agreement may ask for separate consent to electronic signatures.
No Legal, Tax or Financial Advice
Diamondback is not a law firm and does not provide legal, tax, investment or financial advice. State-law information on the site is general educational content that may change; confirm it with your attorney. Nothing on the site creates an attorney-client or fiduciary relationship.
Our Content
The site, its text, graphics, logos and code belong to Diamondback or its licensors and are protected by copyright and trademark law. You may view, print or save pages for your personal, non-commercial use. You may not copy, scrape, republish, frame or resell any part of the site without our written permission.
Acceptable Use
You agree not to use the site for anything unlawful, to submit false information or impersonate anyone, to interfere with the site or its security, to harvest information about other users, or to use automated tools to access the site other than ordinary search engine indexing. We may suspend or block access for anyone who violates these Terms.
Third-Party Sites
The site links to government, court and other outside sites for reference. We do not control them and are not responsible for their content or practices.
Disclaimer of Warranties
The site is provided "as is" and "as available". To the fullest extent the law allows, Diamondback disclaims all warranties, express or implied, including fitness for a particular purpose and non-infringement, and does not promise that the site will be error-free, uninterrupted or current.
Limitation of Liability
To the fullest extent the law allows, Diamondback and its officers, employees and service providers are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data or profits, arising from your use of the site. Nothing in these Terms limits liability that cannot be limited by law, or any right you have under your funding agreement or a state consumer legal funding law.
Indemnification
You agree to defend and hold Diamondback harmless from claims and costs, including reasonable attorneys' fees, arising from your violation of these Terms or your misuse of the site.
Disputes
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute about the site or these Terms that cannot be resolved informally will be decided by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either side may bring a qualifying claim in small claims court, and you may opt out of arbitration by emailing info@diamondbackfunding.com within 30 days of first using the site. Disputes are resolved one at a time; class actions and class arbitrations are waived where the law allows. Anything not subject to arbitration will be heard in the state or federal courts in New York County, New York. Disputes about a funding agreement are governed by that agreement.
Changes to These Terms
We may update these Terms by posting a new version with a new date. Changes apply from the date posted; continued use of the site after that date is acceptance.
General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and Diamondback about the site.
