This Privacy Policy explains what Diamondback Funding Inc. ("Diamondback", "we", "us") collects when you visit www.diamondbackfunding.com, apply for funding, or contact us by phone, email or text; how we use it; who we share it with; and the choices you have. It covers the website and the funding application process.
Information We Collect
Information you give us. On the application form: your name, phone number, email address, state of residence, case type, a short description of your situation, your attorney's name and contact details, and your answers about prior funding and settlement status. If your case moves forward, we may also collect your date of birth, Social Security number, mailing address, a copy of your government ID, and settlement, medical, insurance and lien information, most of it from your attorney's office rather than from you.
Information collected automatically. Our hosting provider keeps standard server logs (IP address, browser and device type, the page requested) to run and secure the site. When you submit a form, we also record the page you arrived on and the site or app that referred you. That referral capture uses session-only browser storage, not tracking cookies, and follows no one across other websites.
Information from others. Case records and documents from your attorney's office, funding decisions and payoff figures from funding partners, and identity or fraud-prevention checks where the law or a funding partner requires them.
How We Use It
To evaluate and underwrite your application; to communicate with you and your attorney about it; to arrange funding, whether through Diamondback or a funding partner; to service a funded advance through payoff; to prevent fraud; to comply with state consumer legal funding laws and other legal obligations; and to run and improve the website. We do not sell your personal information, and we do not share it with anyone for their own advertising.
Who We Share It With
Your attorney's office. Funding requires an attorney representing you on a full contingency fee basis who signs an acknowledgment of the funding agreement. We cannot fund without both. We exchange case information with your attorney's office to evaluate and service your funding.
Funding partners. Funding is provided by Diamondback Funding or one of its funding partners. Your agreement identifies the funding company and states your exact repayment terms before you sign. When a funding partner is involved, we send it your application and case information so it can evaluate, fund and service the advance, and it may contact you and your attorney directly.
Service providers. Companies that host the website, process and spam-filter form submissions, automate our intake, store our records, and run our email and phone systems, each bound to use the information only to provide those services.
Legal and safety. Courts, regulators and law enforcement where the law requires it, to enforce an agreement, or to protect the rights and safety of any person.
Business transfers. If Diamondback is sold or merged, your information may transfer to the successor under this policy.
Calls, Texts and Email
When you submit an application, you agree that we may call or text you at the number you provide about your application, including with automated dialing or prerecorded messages. Consent is not a condition of funding. Message and data rates may apply, and message frequency varies. Reply STOP to any text to stop texts, or HELP for help, and you can tell us by phone or email to stop calls. We do not share your mobile number or your text-message consent with third parties or affiliates for their marketing. You can opt out of marketing email through the link in any such email or by writing to us; we will still send messages needed to service your application or advance.
Cookies and Tracking
The site sets no cookies of its own. It uses three session-only browser storage items: the page you arrived on, the site or app that referred you, and a one-time flag so the thank-you page shows the right message after you submit a form. All three expire when you close the tab. We do not run third-party advertising cookies or analytics scripts. If we add analytics later, we will update this policy first. Because we do not sell or share personal information for advertising, there is no sale or sharing to opt out of, and we do not respond to browser Do Not Track signals. Security
We keep administrative, technical and physical safeguards appropriate to the size of our business and the sensitivity of the information we hold, including access controls on our systems, encryption in transit, confidentiality terms with our service providers, and secure disposal of records we no longer need. No method of transmission or storage is perfectly secure, so we cannot promise absolute security.
Retention
We keep your information for as long as we need it to evaluate or service your funding, to meet legal, regulatory and recordkeeping obligations, and to resolve disputes, and then we delete or anonymize it. Applications that do not result in funding are kept only as long as those purposes require.
Your Rights and Choices
You may ask us to tell you what personal information we hold about you, to correct it, to delete it, or to send you a copy, and you may opt out of marketing. Write to info@diamondbackfunding.com or call (917) 267-8368. We will verify your identity before acting, respond within 45 days, and never treat you differently for exercising a right. An authorized agent may make a request for you with your written permission. If we deny a request, you may ask us to reconsider. Deletion requests cannot reach information we must keep for a funded advance or by law.
State privacy laws. Diamondback is a small company below the thresholds of the California Consumer Privacy Act and similar state laws, but we extend the rights above to every applicant regardless of state. We do not sell personal information, so there is no sale to opt out of under any state's law.
Children
Our services are for adults. We do not knowingly collect information from anyone under 18, and we delete it if we learn we have.
Changes to This Policy
We post changes on this page with a new date. For material changes, we also email applicants whose information we hold.
